| Judges are not lawmakers, they are law interpreters. Because she is involved in judicial activism, she is directly involved in the subverting of the US Constitution like a termite gnawing away at the tree from within. There is nothing whatsoever to recommend about her -indeed she has been the most unqualified of the justices on the court since her 1993 appointment. Furthermore, she should have been DQ'ed from consideration because of the conflict of interest of appointing as a Supreme Court justice a former the lead attorney for the ACLU. Another way of saying it is this: appointing the CEO of Union Carbide as president of the EPA is the same kind of conflict of interest as putting Ms. Ginsberg on the court.

In a common law system, such as is used in the United States (except Louisiana and Puerto Rico, nominally) lawmaking is what judges do - they do not simply say "you win, and you lose." Every judgment stands as a precedent that has the force of declaring the law, beyond deciding that case. Just how binding the precedent is depends usually on what court said it and what court is considering it. Judicial lawmaking is so essential to our system of justice that if judges didn't make law, nearly all of the law that governs your everyday life would be out the window. For example, nearly all of property law is based on judicial precedents handed down over a period of centuries. Regard, here is the weakness in our democracy. Lifetime appointees like Ginsberg who would claim the Constitution a living document and gleefully venture overseas for guidance in their liberal opinions.
